Supplementary competitive performance protection protects goods and services from unfair imitation.
Imitations can not only be identical or almost identical products, but also so-called “copycat acquisitions”, i.e. products for which an existing product was used as a model.

The competitor must have been aware of the product that served as a model. The imitation must at least partially correspond to the original product in terms of its competitive character and be offered as the competitor’s own service. - Unfairness:
There must be additional circumstances that justify the unfairness of the competitor’s conduct, such as the exploitation of the reputation of the counterfeit product.
