How do you defend yourself if Google\u2019s \u201cAI Overview\u201d implies that your business is involved in fraud? <\/p>\n<\/div>\n<\/div>\n<\/div><\/div>\n<\/div>\n\n<h2 id=\"h-was-passiert-wenn-google-mehr-als-sucht\" class=\"wp-block-heading\"><strong>What happens when Google does more than just search?<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">For some time now, when you search for a company on Google, you\u2019ve been getting not just a list of links\u2014but sometimes a ready-made answer as well. Above the actual search results, labeled \u201cAI Overview,\u201d a summary appears that directly answers the search query. Sounds convenient. But it can have devastating consequences for the company in question\u2014especially if the text is simply wrong.   <\/p>\n\n<p class=\"wp-block-paragraph\" id=\"h-uberschrift\">That\u2019s exactly what happened to a German publishing house. Following a search query that combined the company\u2019s name with the term \u201cscam,\u201d the AI overview displayed a statement claiming that the company was \u201cknown for unscrupulous business practices\u201d and was \u201coften perceived as a scam.\u201d Specific allegations were also listed: subscription traps, fake phone calls, failure to unlock paid content, and frequent name and URL changes. None of this had been substantiated.     <\/p>\n\n<h2 id=\"h-was-das-gericht-entschieden-hat\" class=\"wp-block-heading\">What the Court Ruled<\/h2>\n\n<p class=\"wp-block-paragraph\">The Munich I Regional Court subsequently ordered Google to  <a href=\"https:\/\/www.gesetze-bayern.de\/Content\/Document\/Y-300-Z-BECKRS-B-2026-N-11860\">Judgment of May 28, 2026 \u2013 Case No. 26 O 869\/26 <\/a>  ordered to cease and desist by way of a preliminary injunction. The court has prohibited Google from disseminating the disputed statements about the plaintiff companies\u2014including allegations of scams, subscription traps, locked-behind-paywall content, poor accessibility, and alleged connections to other companies. However, the motion was partially dismissed, for example, with regard to the alleged collaboration with a debt collection agency\u2014in this instance, the publishing house had not sufficiently demonstrated that the claim was false.  <\/p>\n\n<p class=\"wp-block-paragraph\">The court based the plaintiffs\u2019 central claim on the right to corporate personality. It viewed the <a href=\"https:\/\/kpw.law\/en\/tag\/kuenstliche-intelligenz-en\/\" id=\"4355\">AI-generated statements<\/a> as an unlawful infringement on the companies\u2019 reputation in business dealings, which could not be justified by any legitimate interest on Google\u2019s part. <\/p>\n\n<div class=\"wp-block-group v4-pattern-general-quote-box has-kpw-blue-background-color has-background has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--60);margin-bottom:var(--wp--preset--spacing--60)\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\" style=\"padding-right:var(--wp--preset--spacing--70);padding-left:var(--wp--preset--spacing--70)\">\n<p class=\"wp-block-paragraph\">It doesn&#8217;t just display search results\u2014in whatever order\u2014as links or with short previews (snippets); rather, the results of the search query are summarized and presented in its own words and according to its own structure.<\/p>\n<\/blockquote>\n<\/div>\n\n<p class=\"wp-block-paragraph\">In doing so, the court made it clear that the AI overview is of a different nature than a conventional search result.<\/p>\n\n<h2 id=\"h-der-unterschied-zwischen-suchmaschine-und-ki-ubersicht\" class=\"wp-block-heading\">The Difference Between a Search Engine and an AI Overview  <\/h2>\n\n<p class=\"wp-block-paragraph\">Until now, search engines have been subject to a relatively lenient standard of liability. Anyone who merely displays links to third-party content is generally not responsible for what appears on the linked pages\u2014and is only required to take action once explicitly notified of an obvious legal violation. For a long time, this protection served as the legal basis on which Google could rely in disputes over search results.  <\/p>\n\n<p class=\"wp-block-paragraph\">The court has now denied this protection for the \u201cAI summary.\u201d The key difference: The AI summary is not merely a reproduction of third-party content, but an independent expression. The AI evaluates, weighs, and structures the information\u2014and in doing so arrives at statements that do not appear at all in the linked sources. In this specific case, for example, the AI response contained claims about connections to other companies that were not found in any of the displayed links. The court therefore concluded that Google must be held responsible for these statements as its own.    <\/p>\n\n<p class=\"wp-block-paragraph\">The court also rejected Google\u2019s argument that users could verify for themselves, using the linked sources, whether the AI summary was accurate. It pointed out that the \u201cAI summary\u201d presents a self-contained, self-explanatory statement\u2014without any indication of possible errors or uncertainties. Someone who reads a newspaper article based solely on the headline shouldn\u2019t have to be told that they should have kept reading. The same applies to the AI summary.   <\/p>\n\n<p class=\"wp-block-paragraph\">The court also pointed out that the AI feature\u2014unlike the search engine itself\u2014is not strictly necessary for using the Internet. A search engine that merely displays links is already useful enough to make the flood of information manageable. The AI summary is an additional feature\u2014which Google can therefore operate even without the special liability protection that was developed for search engines as socially indispensable infrastructure.  <\/p>\n\n<p class=\"wp-block-paragraph\">Finally, the court also rejected the argument that the provisions of the Digital Services Act protected Google from liability. Insofar as the statements in question are the provider\u2019s own attributable statements, the liability exemption for hosting providers does not apply. Civil law injunctive relief claims remain expressly unaffected.  <\/p>\n\n<h2 id=\"h-warum-die-aussagen-im-konkreten-fall-rechtswidrig-waren\" class=\"wp-block-heading\">Why the statements were unlawful in this specific case<\/h2>\n\n<p class=\"wp-block-paragraph\">The court carefully distinguished between the contested statements based on their nature: Some were classified as statements of fact, while others were classified as expressions of opinion.  <\/p>\n\n<p class=\"wp-block-paragraph\">With regard to factual claims, the following applies: False claims that could damage a company\u2019s reputation in business dealings are generally unlawful. The decisive factor here was that Google could not prove that the alleged connections to other companies or the practices described were in fact true. The company had affirmed under oath that it had no connection to the companies in question. Google had not presented any substantial counterarguments.   <\/p>\n\n<p class=\"wp-block-paragraph\">Even in the case of statements that the court classified as expressions of opinion, a claim for an injunction was granted. While expressions of opinion enjoy significant constitutional protection, that protection ends where the opinion is based on false facts. Anyone who calls someone a fraud because they falsely associate that person with certain companies cannot invoke freedom of speech. Several courts have ruled that providers are liable for false statements in such AI-generated representations. <\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Timely and professional advice, along with swift action, are crucial for addressing such legal violations.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"padding-top:var(--wp--preset--spacing--50);padding-bottom:var(--wp--preset--spacing--50);flex-basis:60%\">\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Preserve evidence immediately:<\/strong> AI responses can change at any time. What appears in an AI overview today may look different tomorrow or have disappeared entirely. Document the exact search query, date, and time; the complete AI response; a screenshot of the entire page; and the sources displayed along with their links. Without careful documentation, it will be nearly impossible to prove later what was actually displayed.   <\/li>\n\n\n\n<li><strong>Have a legal review conducted:<\/strong> Not every unfavorable or incomplete representation automatically gives rise to legally enforceable claims. A successful legal action always requires an actual violation of the law. Inaccurate or incomplete wording is not sufficient in individual cases. Have it reviewed to determine whether the AI statement is demonstrably false or misleading and infringes upon a protected legal right.   <\/li>\n\n\n\n<li><strong>Understanding Your Rights:<\/strong> False factual claims made by AI can give rise to claims for injunctive relief, removal, correction, and, where applicable, damages. Depending on the specific case, various legal grounds for claims may apply, including claims for infringement of a company\u2019s right to privacy, damage to creditworthiness, and claims under competition law pursuant to the UWG. In the case of natural persons, such as managing directors or freelancers, additional claims under personality rights and data protection law may also apply.  <\/li>\n\n\n\n<li><strong>Develop a Strategy:<\/strong> Sometimes an incorrect AI response is based on a flawed or outdated source. In such cases, it may make sense to address the source information first, as correcting the source data can influence the AI\u2019s response. In addition, depending on the circumstances, options include a cease and desist letter, a preliminary injunction, or a lawsuit. The appropriate strategy depends on the nature of the misrepresentation, the platform in question, and the extent of the damage, and should be developed with the assistance of a lawyer.   <\/li>\n<\/ol>\n<\/div>\n<\/div>\n<\/div><\/div>\n        <\/div>\r\n    \r\n\n<h2 id=\"h-fazit\" class=\"wp-block-heading\">Conclusion<\/h2>\n\n<div class=\"wp-block-columns v4-pattern-text-copy-half-col is-layout-flex wp-container-core-columns-is-layout-f56f613f wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The decision by the Munich I Regional Court is one of a series of rulings on liability for AI-generated summaries.  <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">AI-generated search results are not a marginal phenomenon; for many users, they are the first\u2014and sometimes the only\u2014source of information about a company. If these results are incorrect, they can cause real economic harm. It is therefore logical that clear accountability now exists for this.  <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Companies that are affected or fear they may be affected should not wait and see.
