February 2026<\/time><\/div>\n\n\n<p>from<\/p>\n\n\n<div style=\"font-style:italic;font-weight:600;\" class=\"wp-block-post-author-name\">Clemens Pfitzer<\/div><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignwide has-global-padding is-content-justification-left is-layout-constrained wp-container-core-group-is-layout-c93ec0be wp-block-group-is-layout-constrained\">\n<p><strong>Can a manufacturer advertise its vitamin juice as a product that gives the body &#8220;immune strength&#8221;? Or is this term already prohibited because it goes beyond the health claims permitted by food law? <\/strong>The Regional Court of L\u00fcneburg has clearly answered this question.  <\/p>\n<\/div>\n<\/div>\n<\/div><\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-saft-mit-immunkraft\">Juice with immune power<\/h2>\n\n<p>A juice manufacturer marketed a product with the designation &#8220;[product name] Immunkraft&#8221;. The product contained vitamins C and A, for which a specific <a href=\"https:\/\/kpw.law\/thema\/health-claims\/\" id=\"4866\">health claim<\/a> is permitted under European law: &#8220;They contribute to the normal function of the immune system.&#8221; So far, so good &#8211; because this claim is expressly permitted under EU law.  <\/p>\n\n<p>However, the plaintiff consumer protection association objected to the use of the term &#8220;Immunkraft&#8221; in the product name as anti-competitive. It argued that this went beyond the content of the permitted health claim and was therefore an impermissible health claim. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-die-entscheidung\">The decision<\/h2>\n\n<p>The L\u00fcneburg Regional Court ruled in favor of the consumer association and condemned the juice manufacturer with  <a href=\"https:\/\/voris.wolterskluwer-online.de\/browse\/document\/ade99156-5441-4d50-ad73-91f54745287c\">Judgment of 18.09.2025 &#8211; Ref. 7 O 8\/25 <\/a>  to cease and desist.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-health-claims-sind-europaweit-streng-reguliert\">Health claims are strictly regulated throughout Europe<\/h3>\n\n<p>In principle, health claims on foods are prohibited unless they are expressly permitted in the EU-wide positive list. A &#8220;health claim&#8221; already exists if even an indirect link is suggested between a food or one of its ingredients and health. <\/p>\n\n<p>The perception of the average consumer is always decisive &#8211; not the intention of the manufacturer.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-warum-immunkraft-nicht-gleichbedeutend-ist\">Why &#8220;immune power&#8221; is not synonymous<\/h3>\n\n<p>The health claim approved for vitamins C and A is: &#8220;The vitamin contributes to the normal function of the immune system.&#8221; Sounds inconspicuous &#8211; but it is not. Because this wording is very precise. It states that the vitamin helps to keep the immune system functioning normally. No more, no less.      <\/p>\n\n<p>According to the L\u00fcneburg judges, &#8220;Immunkraft&#8221; says something different.<\/p>\n\n<div class=\"wp-block-group v4-pattern-general-quote-box has-kpw-yellow-background-color has-background has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--60);margin-bottom:var(--wp--preset--spacing--60)\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\" style=\"padding-right:var(--wp--preset--spacing--70);padding-left:var(--wp--preset--spacing--70)\">\n<p>The term &#8220;strength&#8221; is used as a synonym for &#8220;power&#8221;, which in both cases implies a capacity or ability that goes beyond the normal level.<\/p>\n<\/blockquote>\n<\/div>\n\n<p>In other words: Anyone reading &#8220;immune strength&#8221; is not thinking of a normally functioning immune system. They think of a particularly strong, powerful one, i.e. something above average. However, this is precisely what has not been scientifically proven and is therefore not permissible.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-was-das-fur-die-praxis-bedeutet\">What this means in practice<\/h2>\n\n<p>The ruling is a clear indication of the narrow interpretation that courts apply when dealing with health claims. The following points in particular are relevant for food manufacturers, retailers and marketing managers: <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-produktnamen-sind-keine-werbefreie-zone\">Product names are not an &#8220;advertising-free zone&#8221;  <\/h3>\n\n<p>Health claim regulations apply not only to advertising claims in flyers or on websites, but also to the product name itself. Anyone who calls a product &#8220;Immunkraft&#8221; is already making a health claim. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-kreatives-umformulieren-ist-riskant\">Creative reformulation is risky  <\/h3>\n\n<p>Admittedly, approved claims do not have to be used word-for-word; &#8220;similar&#8221; formulations are also permitted. However, a strict standard applies. An alternative formulation is only permitted if it does not go beyond what the <a href=\"https:\/\/www.efsa.europa.eu\/de\">European Food Safety Authority (EFSA)<\/a> has assessed in the approval process.  <\/p>\n\n<p>&#8220;Similar&#8221; therefore does not mean &#8220;similar sounding&#8221;, but the new wording must not implicitly promise more than the approved health claim. In case of doubt, the verbatim adoption of the EFSA formulation is the safer choice. <\/p>\n\r\n\r\n\r\n\r\n            <div id=\"content-cloner-block_b6f4bb13794438c253548ae4cfbb3332\" class=\"wp-block-visual4-content-cloner alignfull\">\r\n            \n<div class=\"wp-block-cover alignfull is-light has-base-color has-text-color has-link-color wp-elements-b24dfd2c2975c61c616eb74d9a3ea188\" style=\"padding-top:var(--wp--preset--spacing--70);padding-bottom:var(--wp--preset--spacing--70)\"><span aria-hidden=\"true\" class=\"wp-block-cover__background has-secondary-background-color has-background-dim-60 has-background-dim\"><\/span><video class=\"wp-block-cover__video-background intrinsic-ignore\" autoplay muted loop playsinline src=\"https:\/\/kpw.law\/wp-content\/uploads\/loop-1.mp4\" data-object-fit=\"cover\"><\/video><div class=\"wp-block-cover__inner-container has-global-padding is-layout-constrained wp-block-cover-is-layout-constrained\">\n<div class=\"wp-block-columns alignwide is-layout-flex wp-container-core-columns-is-layout-cf05694f wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:40%\">\n<div class=\"wp-block-group alignwide has-global-padding is-layout-constrained wp-container-core-group-is-layout-19e250f3 wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group alignfull is-nowrap is-layout-flex wp-container-core-group-is-layout-6c531013 wp-block-group-is-layout-flex\">\n<h2 class=\"wp-block-heading has-medium-font-size\" style=\"font-style:italic;font-weight:500;letter-spacing:10%\">Received a cease and desist letter?<\/h2>\n<\/div>\n\n\n\r\n<div id=\"multirow-headline-block_ce8bbfb5155426b6f6dd271e5b4f1922\" class=\"wp-block-visual4-multirow-headline alignwide\">\r\n    <div class=\"wp-block-visual4-multirow-headline\">\n\n<p class=\"has-huge-font-size\" style=\"margin-top:0;margin-bottom:0;margin-left:0%;padding-top:0;padding-bottom:0;font-style:normal;font-weight:1000;line-height:1;text-transform:uppercase\">How to react<\/p>\n\n\n\n<p class=\"has-text-align-left has-x-large-font-size\" style=\"margin-top:0;margin-right:0;margin-bottom:0;margin-left:8%;padding-top:0;padding-bottom:0;font-style:normal;font-weight:1000;line-height:0.9;text-transform:uppercase\">You are best advised to<\/p>\n\n\n\n<p class=\"has-text-align-left has-huge-font-size\" style=\"margin-top:0;margin-right:0;margin-bottom:0;margin-left:0%;padding-top:0;padding-bottom:0;font-style:normal;font-weight:1000;line-height:0.9;text-transform:uppercase\">cease and desist letter!<\/p>\n\n<\/div> \r\n<\/div><\/div>\n\n\n\n<p class=\"has-medium-font-size\">A cease and desist letter, e.g. for infringement of competition law, industrial property rights or copyright, should always be taken seriously, as it can have considerable legal and financial consequences.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Timely and professional advice is crucial in order to minimize risks and develop the right strategy.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"padding-top:var(--wp--preset--spacing--50);padding-bottom:var(--wp--preset--spacing--50);flex-basis:60%\">\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Check cease and desist letter:<\/strong> Have the cease and desist letter legally checked. Not every cease and desist letter is justified, formally correct and abusive cease and desist letters are unlawful. <\/li>\n\n\n\n<li><strong>Observe the deadline<\/strong>: Be sure to respond within the set deadline to avoid further legal action such as an injunction or a lawsuit.<\/li>\n\n\n\n<li><strong>Check the cease-and-desist declaration<\/strong>: Do not sign a pre-formulated cease-and-desist declaration without legal advice. It could be too far-reaching and lead to considerable and lasting disadvantages. Once a cease-and-desist declaration has been signed, it is almost impossible to get rid of it and can result in considerable follow-up costs in the form of high contractual penalties.  <\/li>\n\n\n\n<li><strong>Strategy<\/strong>: Regardless of whether the cease and desist letter is justified or not, you should consider the right strategy for responding to the cease and desist letter with professional support. Many aspects play a role here. For example, there may be formal errors or the submission of a cease-and-desist declaration may involve incalculable risks.  <\/li>\n<\/ol>\n<\/div>\n<\/div>\n<\/div><\/div>\n        <\/div>\r\n    \r\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n<div class=\"wp-block-columns v4-pattern-text-copy-half-col is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>The ruling comes as no surprise, as it follows a clear line of German and European case law. Courts had previously ruled that formulations such as &#8220;strengthens the immune system&#8221; are inadmissible, even though they are similar to the approved claim. <\/p>\n\n\n\n<p>A strict standard applies to health claims on food.
