September 2017<\/time><\/div>\n\n\n<p>from<\/p>\n\n\n<div style=\"font-style:italic;font-weight:600;\" class=\"wp-block-post-author-name\">Clemens Pfitzer<\/div><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignwide has-global-padding is-content-justification-left is-layout-constrained wp-container-core-group-is-layout-c93ec0be wp-block-group-is-layout-constrained\">\n<p><strong>Only recently, the ECJ ruled<a href=\"https:\/\/kpw.law\/2017\/06\/15\/aus-fuer-sojamilch-veganen-kaese-und-tofubutter\/\" target=\"_blank\" rel=\"noopener noreferrer\">(we reported)<\/a> that only animal products may be referred to as &#8220;milk, cheese, butter or yoghurt&#8221;. Use for purely plant-based products is not permitted. But what about the term &#8220;like cream cheese&#8221; for a vegan spread?  <\/strong><\/p>\n<\/div>\n<\/div>\n<\/div><\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-veganer-frischkase\">Vegan cream cheese<\/h2>\n\n<p>A company that sells vegan spreads in various flavors, among other things, was sued for injunctive relief. The products had the words &#8220;soy-based spread&#8221; on their side labels and the words &#8220;like cream cheese&#8221; on the lids of the packaging. The word &#8220;like&#8221; was printed in a smaller font than the word &#8220;cream cheese&#8221;. In addition, the lid contained the words &#8220;without milk&#8221;, &#8220;made from soy&#8221;, &#8220;vegan&#8221; and &#8220;lactose-free&#8221;.   <\/p>\n\n<p>The plaintiff is of the opinion that the use of the word &#8220;cream cheese&#8221; for the vegan products is <a href=\"https:\/\/kpw.law\/rechtsgebiet\/wettbewerbsrecht\/\">anti-competitive <\/a>.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-die-entscheidung-des-gerichts\">The court&#8217;s decision<\/h2>\n\n<p>The Regional Court of Constance ruled in favor of the plaintiff and condemned the food company with  <a href=\"https:\/\/dejure.org\/dienste\/vernetzung\/rechtsprechung?Gericht=LG%20Konstanz&amp;Datum=22.06.2017&amp;Aktenzeichen=7%20O%2025\/16\">Judgment of 22.06.2017 &#8211; Ref. 7 O 25\/16 KfH <\/a>.<\/p>\n\n<p>The court confirmed that the term &#8220;cheese&#8221; may, in principle, only be used in the ECJ for products that are dairy products, thereby following the ECJ. However, the food company used the term &#8220;cheese&#8221; here for vegan foods. The fact that the products were labeled with &#8220;soy-based spread&#8221; and the addition &#8220;like&#8221; did not change the infringement. Consumers could still be misled if they assume a dairy product based on the packaging.   <\/p>\n\n<p>In addition, non-dairy products must not give the impression that the product is a dairy product.<\/p>\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n<div class=\"wp-block-columns v4-pattern-text-copy-half-col is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>Caution is required when presenting food products.
