Companies must ensure the protection of minors &#8211; otherwise there is a risk of cease and desist letters <\/p>\n<\/div>\n<\/div>\n<\/div><\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-alterskontrolle-auch-fur-pods\">Age control also for pods<\/h2>\n\n<p>Das Landgericht Bochum hat mit <a href=\"https:\/\/nrwe.justiz.nrw.de\/lgs\/bochum\/lg_bochum\/j2025\/12_O_11_25_Urteil_20250506.html\">Urteil vom 06.05.2025 &#8211; 12 O 11\/25<\/a> entschieden, dass auch der Versand von leeren Nachf\u00fcllbeh\u00e4ltern f\u00fcr <a href=\"https:\/\/kpw.law\/branchen\/tabak-und-e-zigaretten\/\">E-Zigaretten<\/a> eine Alterspr\u00fcfung voraussetzt. Die Beh\u00e4lter sind meist Teil des sogenannten Pods, der sich aus einem Tank\/Beh\u00e4lter und einem Verdampfer zusammensetzt. Diese Teile von nachf\u00fcllbaren E-Zigaretten und Vapes erfreuen sich in j\u00fcngster Zeit insbesondere bei jungen Erwachsenen wachsender Beliebtheit. Dadurch r\u00fccken der Jugendschutz und die damit verbundenen rechtlichen Anforderungen zunehmend in den Fokus. Bietet ein Unternehmen leere Pods im Online-Versandhandel an, ohne eine Alterspr\u00fcfung durchzuf\u00fchren, handelt es wettbewerbswidrig. Geklagt hatte der Konkurrent eines Online-H\u00e4ndlers, der unbef\u00fcllte Pods in seinem Online-Handel ohne Altersverifikation der Kunden ver\u00e4u\u00dferte.<\/p>\n\n<div class=\"wp-block-group v4-pattern-general-quote-box has-secondary-background-color has-background has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--60);margin-bottom:var(--wp--preset--spacing--60)\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\" style=\"padding-right:var(--wp--preset--spacing--70);padding-left:var(--wp--preset--spacing--70)\">\n<p>There is also an infringement relevant to competition law [&#8230;]. The shipping and delivery of the two articles offered by the defendant without age verification violates the<br \/>Youth Protection Act. This is because they are a component and not merely accessories of e-cigarettes.  <\/p>\n<\/blockquote>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-bestandteil-und-nicht-nur-zubehor\">Components and not just accessories<\/h2>\n\n<p>The defendant argued that the sale of empty tanks did not require age verification, as the tank alone was harmless and age verification was only required for filled e-cigarettes. However, the court did not follow this view, but clarified that the products sold (pods\/tanks with vaporizer) are to be classified as essential components of e-cigarettes, even if they do not contain liquids, and not just as mere accessories. They are therefore considered products under the <a href=\"https:\/\/www.gesetze-im-internet.de\/juschg\/BJNR273000002.html\">Youth Protection Act<\/a>, the sale of which is only permitted after age verification.  <\/p>\n\n<p>According to the court, this is also supported by the legislator&#8217;s intention, which can be seen from the explanatory memorandum to the draft law. It states: <\/p>\n\n<div class=\"wp-block-group v4-pattern-general-quote-box has-secondary-background-color has-background has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--60);margin-bottom:var(--wp--preset--spacing--60)\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\" style=\"padding-right:var(--wp--preset--spacing--70);padding-left:var(--wp--preset--spacing--70)\">\n<p>The products are available both as disposable products and as refill products, so that<br \/>the products and refill containers for electronic cigarettes and electronic shishas (containers) are included in the bans<br \/><\/p>\n<\/blockquote>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-unclean-hands-einwand-greift-nicht-durch\">\u201cUNCLEAN HAnds\u201d objection does not apply<\/h2>\n\n<p>From a <a href=\"https:\/\/kpw.law\/rechtsgebiet\/wettbewerbsrecht\/\">competition law<\/a> perspective, it is of interest that the court once again clarified that the so-called \u201cunclean hands\u201d defense &#8211; i.e. the reference to the plaintiff&#8217;s own misconduct &#8211; does not apply in the area of laws that affect the public interest. Accordingly, it was irrelevant that the defendant accused the plaintiff of having behaved in a similar way to itself in other jurisdictions. In such constellations, non-compliance with statutory provisions cannot be relativized by referring to the misconduct of others.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-fazit\">Conclusion<\/h2>\n\n<div class=\"wp-block-columns v4-pattern-text-copy-half-col is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>The decision makes it clear that one&#8217;s own behavior should not be aligned with that of other market participants.
