December 2023<\/time><\/div>\n\n\n<p class=\"wp-block-paragraph\">von<\/p>\n\n\n<div style=\"font-style:italic;font-weight:600\" class=\"wp-block-post-author-name\">Clemens Pfitzer<\/div><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignwide has-global-padding is-content-justification-left is-layout-constrained wp-container-core-group-is-layout-3b99a472 wp-block-group-is-layout-constrained\">\n<p class=\"wp-block-paragraph\"><strong>Der Missbrauch personenbezogener Daten kann Schadensersatzanspr\u00fcche der Betroffenen nach sich ziehen.<\/strong> Doch unter welchen Voraussetzungen k\u00f6nnen Schadenersatzanspr\u00fcche, insbesondere wegen immaterieller Sch\u00e4den, geltend gemacht werden. Dies war bislang umstritten. Eine Entscheidung des Europ\u00e4ischen Gerichtshofs schafft nun Klarheit.\u00a0<\/p>\n<\/div>\n<\/div>\n<\/div><\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-immaterieller-schaden-bei-verstossen-gegen-dsgvo\">Immaterieller Schaden bei Verst\u00f6\u00dfen gegen DSGVO<\/h2>\n\n<p class=\"wp-block-paragraph\">Personen, die aufgrund eines Versto\u00dfes gegen die DSGVO einen materiellen oder immateriellen Schaden erlitten haben, haben einen <a href=\"https:\/\/kpw.law\/rechtsgebiet\/datenschutzrecht\/\">datenschutzrechtlichen <\/a>Anspruch auf Schadenersatz gegen\u00fcber dem Verantwortlichen oder dem Auftragsverarbeiter. Es stellt sich die Frage, wann ein immaterieller Schaden vorliegt und wer hierzu vortragen und dies belegen muss.<\/p>\n\n<p class=\"wp-block-paragraph\">Die deutschen Gerichte haben in der j\u00fcngeren Vergangenheit hohe H\u00fcrden f\u00fcr <a href=\"https:\/\/kpw.law\/themen\/betroffenenrechte\/\">Betroffene <\/a>aufgestellt, wenn diese immateriellen Sch\u00e4den wegen Datenschutzverst\u00f6\u00dfen geltend machen wollen.<\/p>\n\n<p class=\"wp-block-paragraph\">In zwei Verfahren (<a href=\"https:\/\/dejure.org\/dienste\/vernetzung\/rechtsprechung?Gericht=OLG%20Stuttgart&amp;Datum=22.11.2023&amp;Aktenzeichen=4%20U%2017%2F23\">Az. 4 U 17\/23<\/a> und <a href=\"https:\/\/www.landesrecht-bw.de\/bsbw\/document\/NJRE001557170\">4 U 20\/23<\/a>) hat das OLG Stuttgart k\u00fcrzlich Anspr\u00fcche auf immateriellen Schaden gegen Meta (vormals Facebook) wegen eines Datenlecks im Jahr 2018 abgewiesen. Die Begr\u00fcndung lautet, dass der blo\u00dfe Kontrollverlust noch keine immaterielle Beeintr\u00e4chtigung begr\u00fcnde. Auch andere Oberlandesgerichte zeigen sich in Bezug auf den Zuspruch immaterieller Schadensersatzanspr\u00fcche zur\u00fcckhaltend. Ein Grund daf\u00fcr k\u00f6nnte die Bef\u00fcrchtung sein, dass ansonsten eine Vielzahl von Betroffenen Klagen einreichen w\u00fcrden.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verfahren-vor-dem-eugh\">Verfahren vor dem EuGH<\/h2>\n\n<p class=\"wp-block-paragraph\">Es gelangte nun ein Verfahren aus Bulgarien zur Frage des immateriellen Schadens vor den EuGH. Ausgangspunkt war folgender Sachverhalt:<\/p>\n\n<p class=\"wp-block-paragraph\">Die bulgarische Nationale Agentur f\u00fcr Einnahmen (NAP), welche\u00a0 dem bulgarischen Finanzminister unterstellt ist, ist unter anderem mit der Feststellung, Sicherung und Einziehung \u00f6ffentlicher Forderungen betraut. In diesem Zusammenhang ist sie auch f\u00fcr die\u00a0 Verarbeitung personenbezogener Daten verantwortlich. In 2019 wurde berichtet, das in das IT-System der NAP eingedrungen wurde. Infolge des Cyberangriffs sollen <a href=\"https:\/\/kpw.law\/themen\/personenbezogene-daten-im-datenschutz\/\">personenbezogene Daten<\/a> von Millionen von Menschen im Internet ver\u00f6ffentlicht worden seien. Daraufhin klagten zahlreiche Personen die NAP auf Ersatz des immateriellen Schadens, der ihnen aus der Bef\u00fcrchtung eines m\u00f6glichen Missbrauchs ihrer Daten entstanden sein soll.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-missbrauch-personenbezogener-daten-begrundet-schadensersatz\">Missbrauch personenbezogener Daten begr\u00fcndet Schadensersatz<\/h2>\n\n<p class=\"wp-block-paragraph\">Das Urteil des EuGH (<a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=280623&amp;pageIndex=0&amp;doclang=de&amp;mode=req&amp;dir=&amp;occ=first&amp;part=1&amp;cid=6848331\">Urteil vom 14.12.2023 &#8211; Az. C-340\/21)<\/a> hat es nun in sich.<\/p>\n\n<div class=\"wp-block-group v4-pattern-general-quote-box has-kpw-red-background-color has-background has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--60);margin-bottom:var(--wp--preset--spacing--60)\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\" style=\"padding-right:var(--wp--preset--spacing--70);padding-left:var(--wp--preset--spacing--70)\">\n<p class=\"wp-block-paragraph\">Allein der Umstand, dass eine betroffene Person infolge eines Versto\u00dfes gegen die DSGVO bef\u00fcrchtet, dass ihre personenbezogenen Daten durch Dritte missbr\u00e4uchlich verwendet werden k\u00f6nnten, kann einen \u201eimmateriellen Schaden\u201c darstellen.<\/p>\n<\/blockquote>\n<\/div>\n\n<p class=\"wp-block-paragraph\">Der Verantwortliche tr\u00e4gt die Beweislast daf\u00fcr, dass die getroffenen Schutzma\u00dfnahmen geeignet waren.<\/p>\n\n<p class=\"wp-block-paragraph\">Im Fall der unbefugten Offenlegung von bzw. des unbefugten Zugangs zu personenbezogenen Daten durch \u201eDritte\u201c (wie Cyberkriminelle) kann der Verantwortliche gegen\u00fcber den Personen, denen ein Schaden entstanden ist, ersatzpflichtig sein, es sei denn, er weist nach, dass er in keinerlei Hinsicht f\u00fcr den Schaden<br \/>verantwortlich ist.<\/p>\n\n<p class=\"wp-block-paragraph\">Im Fall der unbefugten Offenlegung von bzw. des unbefugten Zugangs zu personenbezogenen Daten k\u00f6nnen die Gerichte aus diesem Umstand allein nicht ableiten, dass die Schutzma\u00dfnahmen, die der f\u00fcr die Datenverarbeitung Verantwortliche ergriffen hat, nicht geeignet waren. Die Gerichte m\u00fcssen die Geeignetheit dieser Ma\u00dfnahmen konkret beurteilen.<\/p>\n\n<div class=\"wp-block-columns v4-pattern-text-copy-half-col is-layout-flex wp-container-core-columns-is-layout-f56f613f wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\" id=\"h-fazit\">Fazit<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Der EuGH erteilt der strengen Auffassung in der deutschen Rechtsprechung eine Absage. Allein der Kontrollverlust kann einen immateriellen Schaden begr\u00fcnden. Verantwortliche m\u00fcssen zudem beweisen, dass die getroffenen Schutzma\u00dfnahmen die Daten zu sch\u00fctzen geeignet und sie in keiner Weise f\u00fcr Sch\u00e4den verantwortlich waren, wollen sie einer Inanspruchnahme entgehen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die Entscheidung erh\u00f6ht das Risiko f\u00fcr Verantwortliche auf Schadensersatz in Anspruch genommen zu werden erheblich und d\u00fcrfte in der Folge zu vermehrten Klagewellen von Betroffenen f\u00fchren.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die bislang aufgestellten H\u00fcrden einiger Oberlandesgerichte die eine Geltendmachung von immateriellen Sch\u00e4den erschwert haben, wurden mit diesem Urteil jedenfalls weitgehend eingerissen. Es bleibt abzuwarten, wie die nationalen Gerichte nun mit den Vorgaben des EuGH umgehen.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div
