April 2023<\/time><\/div>\n\n\n<p>von<\/p>\n\n\n<div style=\"font-style:italic;font-weight:600;\" class=\"wp-block-post-author-name\">Clemens Pfitzer<\/div><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignwide has-global-padding is-content-justification-left is-layout-constrained wp-container-core-group-is-layout-c93ec0be wp-block-group-is-layout-constrained\">\n<p><strong>Kurz vor Start des Stuttgarter Fr\u00fchlingsfestes versuchte die Apel K\u00f6nigs-Alm GmbH die K\u00f6nigsalm auf dem Wasen mit einer einstweiligen Verf\u00fcgung wegen angeblicher Markenverletzung zu verhindern. <\/strong>Der Antrag vor dem Landgericht Stuttgart konnte durch unsere Vertretung erfolgreich abgewehrt werden.\u00a0<\/p>\n<\/div>\n<\/div>\n<\/div><\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\">K\u00f6nigsalm auf dem Stuttgarter Fr\u00fchlingsfest<\/h2>\n\n<p>Die von uns vertretene Familie Renoldi betreibt die K\u00f6nigsalm auf dem Wasen in Stuttgart. Die K\u00f6nigsalm ist eine mobile Festh\u00fctte in Form einer Alm aus Holz, in der bis zu 2.000 Personen Platz finden. Sie existiert seit 2018 und hatte ihre Premiere 2019 auf dem Freimarkt in Bremen.<\/p>\n\n<p>Bereits 2019 wurden die Renoldis wegen der Bezeichnung &#8220;K\u00f6nigsalm&#8221; von der Apel K\u00f6nigs-Alm GmbH abgemahnt. Diese betreibt nach eigenen Angaben eine Gastst\u00e4tte in Nieste in der N\u00e4he von Kassel. Diese besa\u00df damals zwei deutsche Wort-\/Bildmarken mit dem Wortbestandteil K\u00f6nigsalm. Die Abmahnung wurde damals durch einen Anwalt in Bremen zur\u00fcckgewiesen. Danach passierte nichts mehr, so dass unsere Mandanten davon ausgingen, dass sich die Sache erledigt hat.<\/p>\n\n<p>Wenige Tage vor Beginn des <a href=\"https:\/\/www.stuttgarter-fruehlingsfest.de\/de\/home\/\">Stuttgarter Fr\u00fchlingsfest<\/a>s versuchte die Apel K\u00f6nigs-Alm GmbH jedoch beim Landgericht Stuttgart eine einstweilige Verf\u00fcgung zu erwirken, um die Nutzung des Namens K\u00f6nigsalm zu untersagen. Gest\u00fctzt war der Antrag auf die Wortmarke K\u00f6nigsalm,\u00a0 die nach der ersten Abmahnung in 2019 angemeldet wurde. Dabei wurde vor dem Antrag bei Gericht keine Abmahnung ausgesprochen und im Antrag auch mit keiner Silbe erw\u00e4hnt, dass es bereits 2019 eine Abmahnung gab.<\/p>\n\n<p>Das Gericht erlie\u00df die einstweilige Verf\u00fcgung jedoch nicht wie beantragt ohne m\u00fcndliche Verhandlung, sondern setzte einen Termin zur m\u00fcndlichen Verhandlung an.<\/p>\n\n<p>Aufgrund der Vorgeschichte wurde von uns mangelnde Dringlichkeit und Rechtsmissbrauch eingewandt.<\/p>\n\n<h2 class=\"wp-block-heading\">Entscheidung des Gerichts zur K\u00f6nigsalm auf dem Cannstatter Wasen<\/h2>\n\n<p>Das LG Stuttgart (<a href=\"https:\/\/kpw.law\/wp-content\/uploads\/2023\/04\/LG-Stuttgart-35-O-43-23-KfH.pdf\">Urteil vom 19.04.2023 &#8211; Az. 35 O 43\/23 KfH<\/a>) wies den Antrag auf Erlass einer einstweiligen Verf\u00fcgung der Gegenseite mit harten Worten zur\u00fcck.<\/p>\n\n<p>Es bestehe keine Dringlichkeit f\u00fcr den Erlass einer einstweiligen Verf\u00fcgung. Die Antragstellerin habe 2019 ihre Anspr\u00fcche nicht weiterverfolgt und somit zu erkennen gegeben, dass es ihr nicht eilig sei.\u00a0 Auch die Tatsache, dass die Betreibergesellschaft der K\u00f6nigsalm in Bremen in 2019 eine andere war, wobei die Gesellschafter und Vertreter dieselben waren, \u00e4ndert hieran nach Auffassung des Gerichts nichts. Es gebe nur eine mobile Festh\u00fctte &#8220;K\u00f6nigsalm&#8221; und gegen die sei man damals nicht vorgegangen. Wer diese im Einzelfall auf dem jeweiligen Volksfest betreibe sei irrelevant.<\/p>\n\n<h2 class=\"wp-block-heading\">Antrag rechtsmissbr\u00e4uchlich<\/h2>\n\n<p>Zudem beurteilt das Gericht den Antrag als rechtsmissbr\u00e4uchlich. Die Antragstellerin habe versucht sich den Erlass der einstweiligen Verf\u00fcgung durch eine grobe Verletzung ihrer prozessualen<br \/>Wahrheitspflicht zu erschleichen, so das Gericht Hierzu f\u00fchrt das Gericht drei Gr\u00fcnde an.<\/p>\n\n<ul class=\"wp-block-list is-style-arrow\">\n<li>Die Apel K\u00f6nigs-Alm GmbH hat ohne erkennbaren Grund vor Antrag auf Erlass einer einstweiligen Verf\u00fcgung keine Abmahnung ausgesprochen, obwohl dies geboten und m\u00f6glich war.<\/li>\n\n\n\n<li>Die Gegenseite hat weiter beantragt, die einstweilige Verf\u00fcgung ohne Anh\u00f6rung der Antragsgegnerin zu erlassen und falls diese abgelehnt w\u00fcrde um telefonischen Hinweis gebeten. Daraus, so das Gericht, werde &#8211; unter Ber\u00fccksichtigung des Umstandes der fehlenden Abmahnung &#8211; eindr\u00fccklich ersichtlich, dass es der Antragstellerin Kl\u00e4gerin ganz bewusst darauf ankam, die Antragsgegner zu \u00fcberrumpeln und einen sofort vollziehbaren Titel zu erlangen, ohne dass die Antragsgegner zuvor auch nur Kenntnis vom Verfahren haben.<br \/><br \/>Damit h\u00e4tte sie die M\u00f6glichkeit gehabt, die Antragsgegner kurz vor dem Beginn des Fr\u00fchlingsfestes unter erheblichen Druck zu setzen, da diese faktisch keine M\u00f6glichkeit gehabt h\u00e4tten, die Benutzung des Kennzeichens zu vermeiden, ohne den Festbetrieb vollst\u00e4ndig einzustellen.<\/li>\n\n\n\n<li>Die\u00a0 Antragstellerin hat zudem ihre Kenntnis von der Benutzung des Zeichens \u201eK\u00f6nigsalm\u201c f\u00fcr die Festh\u00fctte der Antragsgegner im Jahr 2019 und die an die damalige Betreibergesellschaft gerichtete Abmahnung und deren Erwiderung prozessordnungswidrig verschwiegen.<\/li>\n<\/ul>\n\n<p>Vielmehr war der Antrag so zu verstehen, dass die K\u00f6nigsalm erstmals auf dem Fr\u00fchlingsfest 2023 betrieben werden sollte, was ersichtlich unwahr sei und nur dazu gedient habe, sich eine einstweilige Verf\u00fcgung ohne Anh\u00f6rung zu verschaffen.<\/p>\n\n<p>Dass das Zeichen \u201eK\u00f6nigsalm\u201c f\u00fcr diese eine mobile Festh\u00fctte benutzt wird, wusste die Antragstellerin bereits seit mindestens Oktober 2019. Ebenso wusste sie, dass die verantwortliche nat\u00fcrliche Person dahinter einer der Antragsgegner in ihrer Eigenschaft als Gesch\u00e4ftsf\u00fchrerin der damaligen Betreibergesellschaft war.<\/p>\n\n<h2 class=\"wp-block-heading\">Fazit<\/h2>\n\n<div class=\"wp-block-columns v4-pattern-text-copy-half-col is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>Wenn man vom einem Gericht vorgeworfen bekommt, man habe versucht sich rechtsmissbr\u00e4uchlich eine einstweilige Verf\u00fcgung zu erschleichen, so ist dies eine schallende Ohrfeige f\u00fcr die Antragstellerin.<\/p>\n\n\n\n<p>Das vom Gericht als missbr\u00e4uchlich beurteilte Vorgehen zielte aus unserer Sicht nur darauf ab, mit einer gerichtlichen Entscheidung im Eilverfahren gr\u00f6\u00dftm\u00f6glichen Druck aufzubauen, um dies als Hebel f\u00fcr Geldforderungen zu nutzen.<\/p>\n\n\n\n<p>Wir freuen uns, dass wir den Versuch f\u00fcr unsere Mandantin erfolgreich abwehren konnten und diese nun mit der K\u00f6nigsalm G\u00e4ste auf dem Stuttgarter Fr\u00fchlingsfest begr\u00fc\u00dfen kann.
