Do online retailers have to provide information about every manufacturer&#8217;s warranty on online marketplaces such as Amazon?   <\/strong>According to the European Court of Justice (ECJ) in Luxembourg, there is a comprehensive obligation to provide information about manufacturer warranties under certain circumstances.<\/p>\n<\/div>\n<\/div>\n<\/div><\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-worum-geht-s\">What is it all about?<\/h2>\n\n<p class=\"wp-block-paragraph\"><span id=\"page3R_mcid9\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">A retailer of bicycles and outdoor accessories offered a pocket knife from a Swiss manufacturer on Amazon. The Amazon offer page did not contain any specific information about a guarantee granted by the retailer or the manufacturer. <\/span><\/span> There was only a<span id=\"page3R_mcid9\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page3R_mcid11\" class=\"markedContent\"> link to an information sheet formulated by the manufacturer with the following note: <\/span><\/span><\/span> <\/p>\n\n<div class=\"wp-block-group v4-pattern-general-quote-box has-kpw-red-background-color has-background has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--60);margin-bottom:var(--wp--preset--spacing--60)\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\" style=\"padding-right:var(--wp--preset--spacing--70);padding-left:var(--wp--preset--spacing--70)\">\n<p class=\"wp-block-paragraph\"><span id=\"page3R_mcid9\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page3R_mcid11\" class=\"markedContent\">The guarantee covers any material and manufacturing defects for an unlimited period (two years for electronics). Damage caused by normal wear and tear or improper use is not covered by the guarantee. <\/span><\/span><\/span><\/p>\n<\/blockquote>\n<\/div>\n\n<p class=\"wp-block-paragraph\"><span id=\"page3R_mcid9\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page3R_mcid11\" class=\"markedContent\">The product information sheet did not contain any further information on the guarantee.  <\/span><\/span><\/span><span id=\"page3R_mcid13\" class=\"markedContent\"><\/span>A competitor company was of the opinion that the dealer had not provided sufficient information on the manufacturer&#8217;s warranty and sued him.<\/p>\n\n<p class=\"wp-block-paragraph\">The Federal Court of Justice (Federal Court of Justice) in Karlsruhe initially had to decide on the action and referred the case to the ECJ for a preliminary ruling in its <a href=\"https:\/\/juris.bundesgerichtshof.de\/cgi-bin\/rechtsprechung\/document.py?Gericht=bgh&amp;Art=en&amp;Datum=2021-2-11&amp;Sort=1026&amp;nr=115966&amp;pos=4&amp;anz=9\" target=\"_blank\" rel=\"noopener\">decision of February 11, 2021 &#8211; <\/a><a href=\"https:\/\/openjur.de\/u\/2455517.html\" target=\"_blank\" rel=\"noreferrer noopener\">I ZR 241\/19<\/a>.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-informationspflicht-uber-herstellergarantien-ist-einzelfallabhangig\"><span id=\"page3R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Duty to inform about manufacturer warranties depends on the individual case<br\/><\/span><\/span><\/h2>\n\n<p class=\"wp-block-paragraph\"><span id=\"page3R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The judges in Luxembourg had to comment on this, <\/span><\/span>whether the mere existence of a manufacturer&#8217;s warranty triggers an information obligation on the part of the retailer. If this is not the case, the question was whether the mention of a manufacturer&#8217;s warranty in the retailer&#8217;s offer triggers an obligation to provide information. <\/p>\n\n<p class=\"wp-block-paragraph\">In its <a href=\"https:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2022-05\/cp220075de.pdf\" target=\"_blank\" rel=\"noopener\">judgment of 05.05.2022, ref.C-179\/21<\/a>, the ECJ clarified that <span id=\"page3R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">to the extent that the subject matter of the contract relates to goods manufactured by a person other than the <\/span><span dir=\"ltr\" role=\"presentation\">person other than the trader, the trader must<\/span><span dir=\"ltr\" role=\"presentation\">trader must cover all information relevant to these goods. <\/span><span dir=\"ltr\" role=\"presentation\">for these goods. <\/span><\/span><span id=\"page3R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page22R_mcid0\" class=\"markedContent\">This information includes the essential characteristics of the goods and, in principle, all guarantees associated with the goods as well as the commercial guarantee offered by the manufacturer (&#8220;manufacturer&#8217;s guarantee&#8221;). <\/span><\/span><\/span> <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-generelle-pflicht-zur-angabe-einer-herstellergarantie-ist-unverhaltnismassig\">General obligation to provide a manufacturer&#8217;s warranty is disproportionate<\/h2>\n\n<p class=\"wp-block-paragraph\"><span id=\"page3R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page22R_mcid0\" class=\"markedContent\">However, the Court pointed out that although the provision of information about the manufacturer&#8217;s warranty serves to protect consumers, a general obligation is disproportionate.  <\/span><\/span><\/span><span id=\"page3R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page22R_mcid0\" class=\"markedContent\">Such an obligation would force entrepreneurs to collect and update information about an existing manufacturer&#8217;s warranty at considerable expense.<\/span><br\/><\/span><\/span><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-informationspflicht-nur-bei-berechtigtem-interesse-des-verbrauchers\">Duty to inform only if the consumer has a legitimate interest<\/h2>\n\n<p class=\"wp-block-paragraph\"><span id=\"page22R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">According to the Luxembourg judges, traders are only obliged to provide information about a manufacturer&#8217;s guarantee if the consumer has a legitimate interest in it.<\/span><\/span><\/p>\n\n<p class=\"wp-block-paragraph\"><span id=\"page22R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Such an interest exists if the entrepreneur makes the manufacturer&#8217;s warranty a central or decisive feature of his offer,<\/span> <span dir=\"ltr\" role=\"presentation\">in particular<\/span> <span dir=\"ltr\" role=\"presentation\">if<\/span> <span dir=\"ltr\" role=\"presentation\">he<\/span> <span dir=\"ltr\" role=\"presentation\">from it<\/span> <span dir=\"ltr\" role=\"presentation\">a<\/span> <span dir=\"ltr\" role=\"presentation\">sales<\/span> <span dir=\"ltr\" role=\"presentation\">or advertising argument<\/span> <span dir=\"ltr\" role=\"presentation\">derived from it,<\/span> <span dir=\"ltr\" role=\"presentation\">to<\/span> <span dir=\"ltr\" role=\"presentation\">improve the attractiveness of its offer compared to the offers of its competitors.<\/span><\/span><\/p>\n\n<p class=\"wp-block-paragraph\">Whether the manufacturer&#8217;s warranty is a central feature of the sales offer and must therefore be mentioned is, in the opinion of the court, dependent on the individual case. The content and general design of the offer, the significance of mentioning the manufacturer&#8217;s warranty as a sales or advertising argument and<span id=\"page22R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"> any other aspect that could give rise to an objective <\/span><g id=\"gid_2\">need for protection on the part of the consumer.<\/g><\/span> <\/p>\n\n<p class=\"wp-block-paragraph\">The judges also emphasized that the mere existence of a manufacturer&#8217;s guarantee does not automatically oblige the retailer to provide information about the guarantee. The obligation to inform would only arise if the consumer had a legitimate interest in the information. <\/p>\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n<div class=\"wp-block-columns v4-pattern-text-copy-half-col is-layout-flex wp-container-core-columns-is-layout-f56f613f wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Online retailers who already advertise goods with a manufacturer&#8217;s guarantee must provide all information on the terms and conditions of the guarantee, otherwise they may be subject to cease and desist letters under competition law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no general obligation to provide information, but traders must keep an eye on whether the manufacturer&#8217;s guarantees for their goods are of particular importance to the consumer.
