February 2025<\/time><\/div>\n\n\n<p>from<\/p>\n\n\n<div style=\"font-style:italic;font-weight:600;\" class=\"wp-block-post-author-name\">Clemens Pfitzer<\/div><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignwide has-global-padding is-content-justification-left is-layout-constrained wp-container-core-group-is-layout-c93ec0be wp-block-group-is-layout-constrained\">\n<p><strong>Federal Patent Court<\/strong> declares German and European patent of Wilhelm Layher Verwaltungs-GmbH for scaffolding frames for system scaffolding null and void.  <\/p>\n<\/div>\n<\/div>\n<\/div><\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\">Layher took action for patent infringement<\/h2>\n\n<p>Layher, one of the leading manufacturers of scaffolding, took action against our client for patent infringement. An infringement of the German patent <a href=\"https:\/\/register.dpma.de\/DPMAregister\/pat\/register?AKZ=101123698&amp;CURSOR=0\">DE 101 12 369<\/a> and the European patent <a href=\"https:\/\/worldwide.espacenet.com\/patent\/search\/family\/026008775\/publication\/EP1362150A2?q=EP1362150\">EP 1 362 150<\/a> was asserted.   <\/p>\n\n<div class=\"wp-block-group v4-pattern-general-quote-box has-kpw-turquoise-background-color has-background has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--60);margin-bottom:var(--wp--preset--spacing--60)\">\n<blockquote class=\"wp-block-quote is-style-plain is-layout-flow wp-block-quote-is-layout-flow\" style=\"padding-right:var(--wp--preset--spacing--70);padding-left:var(--wp--preset--spacing--70)\">\n<h2 class=\"wp-block-heading\">Subject matter of the patents:<\/h2>\n\n\n\n<p>The patents both related to a scaffolding frame for system scaffolding with a special connection device for guardrail posts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Main idea of the invention:<\/strong><\/h2>\n\n\n\n<p>The patent claimed a solution in which the rear guardrails no longer have to be attached with wedge couplers, but are instead attached via <strong>elongated holes<\/strong> in the scaffolding rod with a detachable connection.<\/p>\n<\/blockquote>\n<\/div>\n\n<p>Layher took legal action against our client on the basis of these patents before the Mannheim Regional Court. Layher accused our client of also placing scaffolding frames with slotted holes on the market.   <\/p>\n\n<h2 class=\"wp-block-heading\">Action for annulment at the Federal Patent Court<\/h2>\n\n<p>Together with the patent attorneys involved, we filed nullity actions against Layher&#8217;s patents with the Federal Patent Court. Our aim was to have the legal validity of the patent reviewed, as we were of the opinion that it was neither <strong>new <\/strong>in the sense of patent law nor did it <strong>involve an inventive step<\/strong> and therefore should not have been granted from the outset. <\/p>\n\n<p>In our opinion, the subject matter of the granted patent claim 1 is suggested by a combination of already known technical solutions and is therefore not based on an inventive step.<\/p>\n\n<h2 class=\"wp-block-heading\">Judgment: Federal Patent Court declares patents null and void<\/h2>\n\n<p>Nach umfassender Pr\u00fcfung der Sach- und Rechtslage gab das Bundespatentgericht unserer Klage vollumf\u00e4nglich statt. In seinen Urteilen vom 10. Juli 2024 (Az. <a href=\"https:\/\/kpw.law\/wp-content\/uploads\/BPatG-Urteil-8-Ni-32-23.pdf\">8 Ni 32\/23<\/a> und <a href=\"https:\/\/kpw.law\/wp-content\/uploads\/BPatG-Urteil-8-Ni-31-23.pdf\">8 Ni 31\/23<\/a>)  entschied der 8. Nichtigkeitssenat, dass die Patente im Umfang des Hauptanspruchs f\u00fcr nichtig zu erkl\u00e4ren seien.<\/p>\n\n<ul class=\"wp-block-list is-style-arrow\">\n<li><strong>Lack of inventive step<\/strong>: The court found that the patented scaffolding frame essentially used already known technical features and that its technical solution was <strong>obvious from the prior art<\/strong>. The inventive step required for a patent was therefore lacking. <\/li>\n<\/ul>\n\n<div class=\"wp-block-group v4-pattern-general-quote-box has-kpw-yellow-background-color has-background has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--60);margin-bottom:var(--wp--preset--spacing--60)\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\" style=\"padding-right:var(--wp--preset--spacing--70);padding-left:var(--wp--preset--spacing--70)\">\n<p>The subject matter of claim 1 as granted is not patentable because it is not based on an inventive step, since the claimed frame of reference is obvious to a person skilled in the art from the prior art and teachings presented.  <\/p>\n<\/blockquote>\n<\/div>\n\n<ul class=\"wp-block-list is-style-arrow\">\n<li><strong>Technical anticipation by prior art<\/strong>: The court confirmed that the essential elements of the patented solution had already been anticipated in earlier publications and designs &#8211; including the so-called &#8220;H\u00fcnnebeck quick-assembly scaffolding&#8221;. The differences to the prior art were <strong>minimal and obvious to a person skilled in the art<\/strong>, so that no inventive step was recognizable. <\/li>\n\n\n\n<li><strong>Inadmissible extension of the patent in the amended version<\/strong>: The defendant attempted to defend the patent in an amended form (auxiliary request). The court rejected this because the new version went beyond the original disclosure. This attempt to &#8220;rescue&#8221; the patent was therefore also unsuccessful.  <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n<div class=\"wp-block-columns v4-pattern-text-copy-half-col is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>This decision is a <strong>significant success<\/strong> for our client and underlines the need to critically scrutinize patents. Not every technical solution deserves patent protection, especially if it is based on designs that are already known. Layher takes a different view and has appealed against the decisions to the Federal Court of Justice.  <\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n<\/div>\n<\/div>\n\n<div class=\"wp-block-group alignwide has-global-padding
